How Colorado FAMLI works out your benefit
FAMLI uses a single quarter: one-thirteenth of the wages paid in the highest-earning quarter of your base period.
That weekly wage is replaced at 90% up to half the state average weekly wage — $804.46 since July 1, 2026 ($767.47 before) — and at 50% above it. The maximum is 90% of the state average: $1,381.45 through June 30, 2026, and $1,448.02 from July 1, 2026.
Colorado is unusual: when the state average changes on July 1, FAMLI recalculates claims that are already in progress, so a leave that spans July 1 can be paid at two rates.

Worked example
Take a worker paid $68,000 a year with steady pay, taking 12 weeks off (bonding with a new child) from Oct 5, 2026, when the figures for Jul 1, 2026 – Dec 31, 2026 apply. Colorado FAMLI uses the highest base-period quarter ÷ 13: $1,307.69 (highest quarter $17,000).
The formula gives 90% × $804.46 = $724.01 + 50% × $503.24 = $251.62: a weekly benefit of $975.63, or 75% of their usual weekly pay. 12 paid weeks come to $11,707.56.
Over a year, their own payroll contribution is $299.20 — about $5.75 a week.
At $200,000 a year, the same leave pays $1,448.02 a week — the maximum, 38% of that worker’s weekly pay, for a yearly contribution of $811.80.
What catches people out in Colorado
- The premium drops in 2027: 0.88% of wages in 2026 and 0.86% in 2027, up to the Social Security cap. Employers may take up to half from your pay.
- Extra weeks exist: 4 more for pregnancy or childbirth complications, and — for claims from 2026 — 12 more when a newborn is in neonatal intensive care.
- You need $2,500 in base-period wages to qualify.
- No waiting period, but at least 8 hours of leave must accumulate before any benefit is payable.
