What this leaves out: partial weeks (PFL pays by the day, one-fifth of the weekly benefit), employer plans that pay more than the statutory DBL benefit, the higher-of-two 8-week averages rule, and the combined 26-week cap when you take both DBL and PFL in 52 weeks.

How New York PFL & DBL works out your benefit

New York uses your recent pay rather than an old quarter. Your average weekly wage is the average of your last eight weeks of pay before the leave, bonuses and commissions included; the insurer has to use whichever is higher — the eight weeks including the week your leave started, or the eight weeks before it.

Paid Family Leave pays 67% of that average but no more than 67% of the New York State average weekly wage: $1,833.63 for leave beginning in 2026 (a $1,228.53 cap) and $1,922.25 for 2027 (a $1,287.91 cap). The rate in force on the first day of your leave applies to the whole leave. The floor is $100 a week, or your full wage if you earn less than that.

Disability benefits (DBL) are a separate and much older program that employers insure. They pay half your average weekly wage, at most $170 a week, after a 7-day unpaid waiting period, for up to 26 weeks in any 52. The $170 cap is written into Workers’ Compensation Law §204; a bill to raise it passed the state Senate in June 2026 but was still in Assembly committee when we checked, so the old cap still governs.

After the last window, the calculator switches to an explicit “enter the official figure” mode rather than reusing an old maximum.

Worked example

Take a worker paid $1,500 a week with steady pay, taking 12 weeks off (bonding with a new child) from Oct 5, 2026, when the figures for Jan 1, 2026 – Dec 31, 2026 apply. New York PFL & DBL uses the average of the last 8 weeks of pay: $1,500.

The formula gives 67% × $1,500 = $1,005: a weekly benefit of $1,005, or 67% of their usual weekly pay. 12 paid weeks come to $12,060.

Over a year, their own payroll contribution is $368.16 — about $7.08 a week.

At $200,000 a year, the same leave pays $1,228.53 a week — the maximum, 32% of that worker’s weekly pay, for a yearly contribution of $443.11.

What catches people out in New York

  • Birth parents usually use both. DBL covers pregnancy and recovery; PFL then covers bonding. Together they cannot exceed 26 weeks in a 52-week period.
  • Your claim goes to an insurance carrier, not the state. Employers buy PFL and DBL coverage (or self-insure), so you file with the carrier your employer names.
  • The premium rises in 2027. PFL costs 0.432% of pay up to $411.91 in 2026, and 0.452% up to $451.81 in 2027. DBL can cost you up to 0.5% of wages, never more than 60 cents a week.
  • Eligibility depends on tenure, not earnings. 26 consecutive weeks working 20+ hours a week, or 175 days if you work part-time.
  • Partial weeks are paid by the day at one-fifth of your weekly benefit, so intermittent leave adds up differently from the full weeks shown here.
